Please read these Terms of Service carefully before using IslaApp. These terms constitute a legally binding agreement between you and IslaApp regarding your use of our platform and services.
1. Acceptance of Terms
By accessing or using IslaApp ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. IslaApp reserves the right to update these terms at any time, and continued use of the Service constitutes acceptance of the revised terms.
2. Description of Service
IslaApp provides a website builder platform that allows users to create, customize, and publish websites using pre-built templates. The Service includes AI-powered editing tools, hosting on *.onislaapp.com subdomains, and optional custom domain configuration.
3. User Accounts
You must create an account to access the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information during registration and keep it up to date.
4. Subscription Plans & Billing
IslaApp offers Free, Starter, and Business subscription plans. Paid plans are billed monthly or annually as selected at checkout. All fees are non-refundable except as required by law. Downgrading your plan may result in loss of features or published sites. You may cancel your subscription at any time from your dashboard.
5. AI Credits & Usage
Paid plans include AI credits used for AI-powered customization features. Credits reset monthly on your billing date and do not roll over. Unused credits expire at the end of each billing cycle. IslaApp reserves the right to modify credit allocations with 30 days notice.
6. Acceptable Use
You agree not to use the Service to publish content that is unlawful, harmful, fraudulent, or infringes on intellectual property rights. You may not use the Service to send spam, distribute malware, or engage in any activity that disrupts or interferes with the Service. IslaApp may suspend or terminate accounts that violate these policies without notice.
7. Intellectual Property
You retain ownership of content you create and publish through the Service. By using the Service, you grant IslaApp a non-exclusive, worldwide license to host, display, and deliver your content as necessary to provide the Service. IslaApp templates, code, and platform are the intellectual property of IslaApp and may not be copied or redistributed.
8. Custom Domains
Custom domain configuration requires you to provide your own domain and update DNS settings as instructed. IslaApp configures SSL and routing via Render. IslaApp is not responsible for domain registration fees, expiration, or DNS propagation delays.
9. Limitation of Liability
To the fullest extent permitted by law, IslaApp shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service. Our total liability to you shall not exceed the amount paid by you to IslaApp in the 12 months preceding the claim.
10. Termination
IslaApp may terminate or suspend your account at any time for violation of these terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. Published sites on custom domains may remain accessible for up to 30 days after termination.
11. Governing Law
These Terms are governed by the laws of the State of Florida and the United States of America. Any disputes arising under these Terms shall be resolved in the courts of Miami-Dade County, Florida.
